COMMISSION NEWS

The City of Calgary appealed a human rights panel decision (Susan L'Archeveque v. The City of Calgary, May 17, 2002) to the Court of Queen's Bench. The panel held that the City failed to accommodate the complainant employee's physical disability to the point of undue hardship. The Court upheld the finding of the panel that the City failed to accommodate and upheld the award for lost wages, benefits and interest. The Court found the panel's award for damages to be excessive and reduced it from $9,000 to $4,000. Read the complete decision.
